DiMatteo indicted on federal charges; S. Tahoe never did background check on pot club owner

Gino DiMatteo has been indicted by a federal grand jury on three drug charges.
The grand jury had been looking into DiMatteo for longer than the city of South Lake Tahoe has allowed medical marijuana dispensaries to operate within its borders. The federal investigation was between June 1, 2009, and Sept. 5, 2012, with the indictment being handed down Nov. 21.
DiMatteo operated City of Angels II collective until this summer when he had to close shop because his landlord wanted him out and the City Council would not allow him to move his operation. Since then he bought Push Fitness.
Right now he is sitting in a Sacramento jail awaiting a bail hearing set for Nov. 26.
The indictment reveals DiMatteo was convicted in January 2002 in New York of conspiracy to distribute marijuana.
No one with a felony conviction was supposed to receive a permit by South Lake Tahoe officials to operate a medical marijuana collective.
When DiMatteo was arrested in August on state charges the documents included reference to a felony weapons charge from 1999 in New Jersey. At that time city officials believed the reason that charge did not turn up in their search was that DiMatteo also goes by Sergio Franco Ottomanelli.
Names can change, but fingerprints don’t; so that logic was suspect.
Lake Tahoe News has since learned that the city does not have DiMatteo’s prints.
“We did have a checklist. We did not have checked off the criminal history review,” Police Chief Brian Uhler told Lake Tahoe News. “We dropped the ball. I don’t have any other way of putting it.”
DiMatteo did go in to have his prints run. But he outsmarted officials by having the number at the top of the paperwork go to some obscure firm instead of back to the city, Uhler said.
Ultimately it is the city manager who issues pot club permits. That would have been Tony O’Rourke in this case.
“I was told those applicants were screened,” O’Rourke told Lake Tahoe News. “Yes, I was ultimately responsible. When I signed off it was based on everything being reviewed and consistent with requirements.”
Clearly, that was not the case. And clearly O’Rourke did not review the checklist and instead went with what he was told, not with the facts.
What is not known is why the city attorney would allow the city manager to sign the permit without everything being in order. City Attorney Patrick Enright did not return a phone call.
While it’s possible DiMatteo would still be in trouble with the feds because they were looking at him before he set up shop in South Lake Tahoe, had the city done its due diligence and all the players done their jobs accurately, the resulting chaos involving Councilwoman Angela Swanson would not likely have been an issue. This is because DiMatteo would not have had a business from which to make a donation to a nonprofit she is affiliated with.
Swanson got caught up in the DiMatteo matter in August when the El Dorado County District Attorney’s Office charged DiMatteo with bribing a public official – Swanson. While the charges against DiMatteo have been dropped, the DA says he is still investigating city officials and keeps Swanson on a yo-yo in what appears to be a game of politics.
The three counts leveled against DiMatteo in the indictment are conspiracy to manufacture and possess with intent to distribute marijuana; possession with intent to distribute marijuana; and manufacture marijuana.
If DiMatteo were convicted of at least one of the offenses, he would have to give up all his property deemed to have been associated with or bought by money from drug transactions.
If convicted on three counts, DiMatteo could face 60 years to life in prison and fines of more than $30 million.
Rob Woelfel, DiMatteo’s attorney, was not available for comment.

Gee, what a surprise! Of course, they did have a Mayor convicted for money laundering in another drug scandal years ago. Guess they never learn… Nobody questioned the flamboyant lifestyle (lots of gold, expensive sports car & no apparent job)then. Guess this will be part of the “O’Rourke Legacy”.
And the city still thinks they deserve to be paid as much as other cities? I know, they’re going to say that they do a bad job because they don’t have the revenue to do a good job.

Absolutely appalling! Was the city trying to save money by not doing the background check. This is absolutely ridiculous and city employees responsible need to be held accountable!
Back ground checks are the responsibility of law enforcement, not the City Manager or City Attorney. The mistake and responsibility are completely on the Chief of Police. The Chief said it clearly “we dropped the ball”.
Yes, Centurion, however, the City Manager and City Attorney are just as responsible…was there a “background check” to confirm? And who confirmed or didn’t confirm it?
At any rate, human nature is often to reap the most benefits for the least amount of work. Especially as one climbs the food chain…makes more money…gains more prestige. The “ball was dropped”…admittedly. So what now? Who will be held accountable?
Again, we continue to reward mediocrity.
Could it be that this is a new frontier, and protocol/policy was not developed/written up yet?
It would be nice to think of everything ahead of time, but this was a new business, very different than any other business, and this slipped through the cracks?
Hope we do not have any costly repercussions due to this error, and I would guess they won’t let this happen again!
These fiascos would not happen so often if there was accountability tied to responsibility in SLT. The Chief of Police should not get off with just saying Duh… “we dropped the ball”… he needs a salary cut tied to that “ball”. The City Attorney is paid the bigger bucks to ensure the rest of the management does their job lawfully, and I don’t think we should pay for these employees who can’t seem to do the job. They need performance salary cuts for these huge mistakes, or fire them. There are lots of compentent folks out there looking for work — get rid of the lazy, incompetent ones who cost us money and stress out our city. Change the City Charter if necessary. Get a City Attorney who earns his salary by protecting our City. Clean house….
This falls on the SLTPD. But was Mr. Uhler Chief when Gino applied for the permit? Anyway, maybe our PD should spend more time & effort researching such things, (and believe me there are a lot of prior felons wandering around our town in all kinds of permitted businesses), instead of pulling over us law abiding citizens for the silliest and most mundane of reasons!
So city employees become political targets; the quality of new hires, both line level and managerial, goes down and now folks are surprised that the competence of city departments goes down as well? Hang on folks; it’s only just begun.
The City of SLT and most departments in it are a joke. The City continually hires people from out of the area(great), they move here, realize they don’t like it, or are here to double dip, then they leave in five years. Do you think Uhler is here for long haul, not. He’s putting his five years to collect his second pension and he’s outta here. If you are hired as a police/fire/human resource, etc. dept head, how long does it take develop a long term plan. You need to know where you have been something none of these guys know. Dissolve the City.
Meanwhile the heroin and pain pill epidemic continues. Maybe we need another puppy store to obsess over.

Well pointed out careabout! I love that just a couple of months everyone was defending this felon and his business, now the same ones are ignoring that fact and harping on something that is over and done with. All of this harping is not going to change history and you know that this won’t happen again. Be thankful this drug dealer is off the streets and not involved in distribution any more. Now, we go after the heroin dealers.

Anyone can do a little research on the subject, but this isn’t the first blunder from the City. The City was also working with a business called “Total Business Images.” Total Business Images created many websites for the City, AND many businesses in the city were using TBI. Not newsworthy right? Well except for that the business was owned and operated by two convicted pedophiles. A child molester and a child pornographer. Both highly recommended and endorsed by the chamber as well.

I just watched this story on the Reno news, its embarrassing the PD messed up this background investigation. Now channel 2 is “investigating” with more on the story tomorrow. Why is the Chief not held accountable for this? Who approved the permit and signed off on the background? Makes our City look bad.
